I'm thrilled that you're considering working with me to bring your vision to life.
Before we get started, I want to ensure that we're on the same page and that you understand my terms of services.
As a digital artist, I take pride in my work and strive to provide the best possible experience for my clients, and I'm here to help you bring your unique vision to life.
To ensure that our collaboration runs smoothly and that we're both happy with the final result, I have a few terms of service that I ask my clients to abide by.
These terms are designed to protect both of our interests and ensure that we have a clear understanding of what to expect throughout the commissioning process.
So please take a moment to review my terms of service before we begin.

1. General guidelines
By commissioning me, you agree to have read and fully agreed to my terms of services.
Prices shown are for personal use only.
I retain all the rights to my work, which include but are not limited to the right to distribute, reproduce, copy and/or use the image as a sample for sales or self-promotion.
I do NOT authorise using any of my pieces as NFT.
Furthermore, I do NOT authorise using any of my pieces to feed any AI generator or use in an AI generator in any way.
I reserve the right to refuse any commission.
Any ill behaviour will not be tolerated.
Price will vary depending on the complexity of the character design, background or other elements I deem fit.
2. Payment
At the moment, I accept payment via Paypal (PayPal fee 5% will be added to the final cost of the illustration.)
Payments can be either :
50% before I start your commission and 50% before I send the finished piece.
OR 100% before I start working on your commission.
I will ONLY start working on your commission after receiving full or the first-rate of the agreed payment.
Rush fee + 50% of the final price
! Rush fee means that you will be put at the top of my to-do list !
3. Usage of the illustration
I, Kristina (the artist), claim the rights to the produced drawing, not the commissioner. Therefore I am allowed to use the copyrighted artwork to:
Promote myself with it everywhere
Display it everywhere to my liking (website, social media, etc.)
Post it wherever I want.
The commissioner reserves the right to:
Claiming rights to the character, but not the drawing itself.
Sharing/Reposting the artwork any place they see fit, with proper credit.
Printing the artwork for personal use only.
The following is considered copyright infringement:
Reproducing/using copyrighted artwork commercially without my knowledge.
Claiming the artwork as your own.
Removing my signature from the artwork.
Changing the artwork without my consent.
I reserve the full rights to the image and it's use/distribution unless otherwise agreed upon (rights to the image for your own non-personal use may be purchased at any time).
The client must credit the artist properly:
Social media: @madmire_
Books or websites: madmire
Commercial rights is extra 30%-150% of final quote price.
Copyright belongs to the artist, unless full copyright is bought by the client.
Personal Use
Includes:
Private use (profile picture, personal wallpaper, personal gift)
Sharing on social media with credit to the artist
NOT permitted:
Use for commercial purposes
Including the illustration as part of a product, book, or merchandise, even as a gift
Example: You can use it as an illustration for your book on social media or give it to your friend, but you can't include it in a book or product that you distribute for sale physically or electronically (e.g. kindle)
Commercial Use
Includes:
Use on products or materials for profit or commercial distribution
Covers, promotions, merchandise, etc
4. Delivery time
The time it takes to finish your commission varies 3-6 weeks, depending on factors such as health, the complexity of the commissioned piece, other working commissions.
If anything comes up that will slow the progress of the initially estimated delivery time I will let you know ASAP.
Once the piece is finished you will receive the full-resolution image via email. Note that there is no physical product.
It is the buyer’s responsibility to save the files received. Loss of the files is not the responsibility of the creator.
The artist will not provide a physical copy of the digital piece and she won’t be in charge of providing one even if the consumer offers to pay more for it.
5. Refunds and cancelling
Refunds aren't accepted except for the following case:
If the artist does not believe being able to deliver what was desired by the customer after accepting the commission.
The finished product hasn't been provided in three months.
Client canceled their commission before the artist began working on the commission.
Steps of the progress are provided during the commission process, which means disliking the final result or changing of mind will be never considered a refund.
If you do not respond to my messages/emails within 3 weeks of sending you the last one, the order is canceled and the paid amount is non-refundable.
After 2 days of unpaid invoice, your slot will be forfeited if another person pays in due time.
IMPORTANT: If you request a Paypal chargeback at any point when you were not allowed to ask for a refund you will lose all aforementioned rights to the commissioned piece and I will have the full right to profit further from it in any way. I will decline the chargeback and supply Paypal with our conversations in which we talk about the commission as evidence that I have completed work for you. Furthermore, you will be blacklisted from commissioning me again.
6. Revisions
Commission revisions are next : Any changes made during the sketch phase are free of charge (unless it is large changes). You get 2 minor changes on the color blocking stage included in the price. And 1 minor change on the final piece included in the price.
The amount of the extra charge depends on the change you want me to make.
If you wish to change a part of the painting you have previously approved, I will charge you an extra fee.
Any mistakes from my end will be fixed for free.
7. Commission’s information
Provide numerous useful references. I can guide you if needed, just state it.
In the case where you have any size, resolution and/or colour mode requirements, please inform me as soon as possible. If I already created the file and worked on it, I might not be able to change it.
Description of the wanted commission is required, the more details the better ! You can also try to sketch your idea in paint : I’ll take everything !
